New Jersey's Fourth Round Affordable Housing Numbers Released
In accordance with the recent Fourth Round affordable housing legislation signed into law earlier this year, the New Jersey Department of Community Affairs (DCA) released its Fourth Round affordable housing numbers for each municipality. This is the first step in this new Fourth Round affordable housing process. Municipalities have until January 31, 2025 to adopt, and commit to satisfy, their Fourth Round obligation. Municipalities also have until June 30, 2025 to adopt a Housing Element and Fair Share Plan (HEFSP) that addresses their Fourth Round obligation. Please see our prior alert on the Fourth Round affordable housing law addressing the various deadlines and changes to compliance mechanisms.
Any challenges by third-parties to a municipality's adoption of its Fourth Round obligation or its HEFSP will go to the Affordable Housing Dispute Resolution Program, referred to as "The Program." Earlier this year, the Administrative Office of the Courts appointed seven retired judges to serve on The Program.
