Overview
Daniel "Dan" Carragher's practice combines reorganization, bankruptcy, and workout experience with the structuring and closing of complex financing and corporate transactions. As a partner in our Bankruptcy and Creditors' Rights practice group, he maintains an active practice in regional and national Chapter 11 and insolvency matters, representing secured creditors, major unsecured creditors, suppliers, landlords, equipment lessors, acquirers and other parties. Dan also regularly represents borrowers, lenders, investors and equipment lessors in private placements, equipment finance, bank loans, and other private finance transactions.

Bankruptcy and Workouts
Represented buyers of patents, intellectual property rights, nanotechnology assets, real estate, aircraft components and operating businesses in section 363 sales in New York, Delaware, Massachusetts and other jurisdictions
Represented the largest supplier to Hawker Beechcraft as a creditors' committee member in its Chapter 11 case in New York
Represented aircraft finance parties, lessors and key suppliers in the American Airlines Chapter 11 case in connection with restructuring of multiple aircraft finance transactions, assumption of contracts, resolution of tax indemnity claims and resolution of intercreditor disputes
Represented aircraft finance parties, aircraft and engine lessors and key suppliers in Delta Airlines, Northwest Airlines, Global Aviation Holdings, Gulfstream International Airlines, DayJet Corporation, Eclipse Aviation, Aloha Airlines and aviation and aerospace bankruptcies
Successfully defended equitable subordination claims challenging loans to insolvent venture by majority shareholder
Advised financial participants and forward contract merchants on termination and settlement of swaps and derivatives in Lehman, MF Global and other cases
Served as debtor's special finance counsel in $700 million recapitalization of International Place office towers in Boston and in reorganization of specialty finance lender in Connecticut
Represented ad hoc committees of holders of over $5 billion of securitization notes in Chapter 11 cases of Conseco Finance in Chicago and DVI Financial Services in Delaware
Workouts and Restructurings
Represented private placement investors in successful restructuring of door and window manufacturer, including collateralization of debt, negotiation of intercreditor arrangements with senior bank group and early payoff of debt with full make-whole
Workouts and restructurings of asset based loans, equipment leases and corporate aircraft loans to real estate developers, printing company, trucking companies, marine shipping companies, contract manufacturers and other businesses
Represented private placement investors in successful tax-efficient restructuring and wind-down of $50M project finance investment in five undersea cable maintenance vessels
Capital Markets
Represent lenders, lessors and investors in financing and leasing of transportation assets, including aircraft engines, maritime vessels, shipping containers and other equipment
Represent borrowers and issuers in connection with senior and mezzanine loans backed by commercial real estate, fine art, oil and gas properties and other assets
