Overview
The complexity, expense and importance of insurance coverage and reinsurance disputes have never been more significant. These matters often involve high internal and external costs and present material risks. Representing insurers and reinsurers in litigation, arbitration and regulatory proceedings has been a major focus of Day Pitney's practice for the last 50 years. Our long track record is the foundation on which today's practice is built and the guide for our continued innovation. We bring a deep connection with and understanding of the insurance industry as a whole. Day Pitney's Insurance and Reinsurance practice has distinguished itself as a genuine "one-stop" solution for insurance and reinsurance matters. Day Pitney has more than two dozen attorneys focused on the insurance/reinsurance industry, providing a depth of knowledge and experience. All of our partners have tried major cases and arbitrations in many jurisdictions throughout the country. Our attorneys also take a leading role in shaping cutting-edge issues in the industry. They actively participate in organizations such as ARIAS-U.S. and serve as adjunct professors and lecturers at the University of Connecticut School of Law.
Insurance Coverage
We play a prominent role in many of the major coverage cases involving primary and excess property/casualty policies. We also handle case-specific and class action claims arising under property/casualty, life and disability policies.
Reinsurance
Cedents and reinsurers from around the world entrust Day Pitney with a wide variety of judicial and arbitral proceedings. Each year our attorneys try a significant number of these matters to conclusion. We also assist our clients in structuring creative solutions to disputes, including commutations, novations and other arrangements.
Insolvency
Day Pitney assists creditors, counterparties and regulators in the specialized area of law in which insurance and financial distress intersect. Day Pitney attorneys safeguard clients’ interests in all aspects of an insurer’s insolvency: from runoff to supervision and from rehabilitation to liquidation. We also assist insurer clients in dealing with insolvent insureds.
Extra-Contractual Claims
We regularly represent insurance companies against extra-contractual claims of bad faith and unfair trade and insurance practices. We also have significant experience with the reinsurance implications raised by such claims.
First-Party Insurance
Day Pitney has served as national counsel and handled cases in various state courts across the country. Our experience goes beyond the policy terms and extends to the engineering, financial and accounting issues surrounding the claims.
