Coal Co.'s Win Won't Diminish EPA's Regulatory Clout
Harold Blinderman was quoted in an article, "Coal Co.'s Win Won't Diminish EPA's Regulatory Clout," in Law360. In the article, he discusses the significance of the case, Murray Energy Corporation et al v. Administrator of Environmental Protection Agency, in which the federal District Court for the Northern District of West Virginia granted summary judgment to Murray Energy. The court found that EPA had failed to comply with a provision of the Clean Air Act requiring that the agency monitor the impact of the agency's air regulations on employment. While the EPA conducts various economic impact evaluations as part of rulemakings and statutory requirements, "the district court said that wasn't enough," Blinderman observed.
