Fox News Must Face Ex-Ad Client's Accounting Scheme Suit
A New Jersey federal judge decided that a case filed by Day Pitney on behalf of its client Unimed International can proceed. Unimed, an antioxidant seller, filed complaint against Fox News for wrongfully diverting Unimed's funds and wrongfully blocking Unimed from continuing to advertise on the network. Judge Susan Wigenton denied Fox News' motion to dismiss the Unimed complaint, and the case will proceed.
Mark Salah Morgan, who led the Day Pitney team, said, "We are pleased that the court recognized the viability of Unimed's claims against Fox News and we look forward to proceeding with discovery and proving Unimed's claims at trial."
Morgan was joined by Richard H. Brown and Michael L. Fialkoff in Day Pitney's representation of Unimed. The matter was covered in Law360, "Fox News Must Face Ex-Ad Client’s Accounting Scheme Suit."
