Listing Former Lawyer As Witness Waives Privilege

Day Pitney Litigation Partner Mark A. Romance was featured in the article, "Listing Former Lawyer As Witness Waives Privilege," in the American Bar Association's Litigation News newsletter. Romance commented that lawyers "need to be vigilant about limiting the [lawyer's] testimony to factual observations and should carefully craft the testimony to be limited to the lawyer's factual knowledge derived from personal observations and not based in any part on communications with the client."

Romance is a co-chair of the ABA Litigation Section's Commercial & Business Litigation Committee.
