FTC Votes 3-2 on Final Rule to Ban Noncompete Agreements, But Legal Challenges Expected

Brochin commented via email, "From a practical perspective, this is not the final say—employers do not need to shred their non-competes. We could still be talking about this, and continue to remain uncertain about the future of noncompetes, in a month or even after the presidential election. Employers contemplating noncompetes with senior executives should keep in mind that if the noncompete ban does become effective (120 days after publication of the final rule) that they will no longer be able to enter those agreements."
