Overview
Benjamin Haglund practices in the areas of high-stakes product liability disputes, shareholder/investor suits and commercial disputes for major corporate clients throughout the U.S. His experience includes jury trials, bench trials, arbitration hearings and mediation in complex matters.
Clients seek out Benjamin’s counsel with the evaluation and planning of short- and long-term litigation strategy at the state, regional and national levels. He leads joint litigation defense groups in New Jersey and New York and also serves as lead medical and liaison counsel.
Benjamin speaks and publishes often on products liability and other complex, defense-oriented litigation issues, including articles published by the Metropolitan Corporate Counsel, Lawyers Weekly USA and Law360.

Products Liability/Mass Tort
Defense of international bank, a premises owner, in over 340 toxic tort personal injury suits filed in the Southern District of New York arising from the terrorist attacks of September 11, 2001
Defense of major pharmaceutical company and its anti-platelet aggregation product in wrongful death suit; obtained summary judgment
Defense of restaurant equipment manufacturers in property damage cases arising from substantial restaurant fires
Defense of alternate fuel engine manufacturer in claim arising from substantial fire at light manufacturing facility alleged to be related to fork lift engine
Defense of an electrical cable and wire manufacturer in over 600 cases filed by electricians in New York, Pennsylvania, New Jersey and Massachusetts; as a part of this defense, Mr. Haglund conducted a consolidated jury trial of 13 cases alleging injury and death from work with asbestos-containing wire and cable; after three months of trial and three weeks of deliberation, the jury returned defense verdicts in favor of our client in all cases; Mr. Haglund successfully defended the jury's verdicts on appeal
Defense of manufacturers and suppliers of pumps, valves, seals, dryer felts, caulk, boilers, commercial ovens, ship engines, alternate fuel engines, power plants, paint and construction materials in over 800 asbestos personal injury and wrongful death cases and appeals filed in New York, New Jersey, Ohio, Michigan, Illinois, and Massachusetts.
Defense of real estate owners in asbestos personal injury suits filed in New York, New Jersey, Texas, Illinois, and Delaware relating to manufacturing sites, distribution centers and office buildings located in New York, New Jersey, Arizona, Texas, and Tennessee
Personal counsel to current and former owners of manufacturers and suppliers of asbestos-containing materials and machinery in issues arising from asbestos personal injury and wrongful death suits filed in New York, New Jersey, Illinois, Massachusetts, Michigan, Rhode Island, Connecticut, California, Pennsylvania, North Dakota, Alabama, Georgia, Texas, Mississippi, and other jurisdictions
Defense of alternate fuel engine manufacturer in claim alleging death by carbon monoxide poisoning
Defense of special education school in matter involving choking death of a student
Shareholder/Investor Suits
Prosecution and trial to verdict of close corporation dispute on behalf of shareholder claiming 50 percent ownership of commercial office building; after trial, a significant judgment was entered in favor of our client
Prosecution of breach of fiduciary duty action on behalf of substantial individual investor against investment advisor who failed to diversify investments
Defense of public food distribution company in investor class action suit challenging fair process and fair price for going private transaction
Defense of international appraisal company in an action arising out of the purchase of the assets of an equipment manufacturing business; Mr. Haglund obtained summary judgment and successfully defended this matter on appeal
Commercial Disputes
Prosecution and trial to verdict on claims involving sales of silicone products; our client was awarded $2.2 million in compensatory damages and attorney fees plus a three-year, world-wide injunction against a former vice president based upon his diversion of suppliers, customers, and products
Prosecution of counterclaim based on sales of defective steel coatings and paints that had been applied to thousands of commercial truck trailers across North America; after a full series of arbitration hearings, a significant net award was entered in favor of our client, the truck trailer manufacturer
Prosecution of breach of supply contract claim on behalf of pharmaceutical manufacturer against pharmaceutical compounding company
Prosecution of action to terminate pharmaceutical license and supply agreement on behalf of licensor and compel transfer of NDA (new drug application)
Prosecution of counterclaim and defense of alternate fuel company in warranty and breach of contract suit related to conversion of truck engines to compressed natural gas fuel
Defense of national bank in suits alleging negligence and fiduciary breach due to federal seizure of funds
