Eric Kaviar counsels intellectual property owners—from Fortune 500 companies to established entrepreneurs and start-ups across various industries—on disputes and litigation, including patent, trademark, and trade secret matters. He also provides them with strategic IP counseling on managing and protecting their intellectual property portfolios, helping them to meet their evolving needs in technology-driven industries.
Eric has a proven track record of successfully representing clients in patent, trade secret, and trademark law disputes. With more than 17 years of experience, Eric has extensive experience representing clients in complex intellectual property matters from pre-filing investigations through trial and appeal, including proceedings before the International Trade Commission (ITC). He brings a creative and tailored approach to each representation, prioritizing outcomes that align with the client’s business goals.
Eric has litigated cases involving a wide range of technologies, including video gaming, voice over internet protocol (VoIP), content delivery networks, electrophoretic displays, optical equipment, point-of-sale (POS) devices, medical devices, and software applications.
Before joining Day Pitney, Eric held partner positions at two leading law firms, where he managed complex intellectual property disputes and represented clients in high-stakes technology cases. His technical knowledge and litigation experience make him a trusted advisor for clients navigating today’s fast-evolving IP landscape.
Experience
Successfully represented a major international firearm company in a variety of patent infringement suits, both as plaintiff and defendant
Effectively defended notable video games company in several patent infringement suits, including multiple suits brought before the ITC and at the United States Patent and Trademark Office (USPTO)
Defended a former employee against trade secret misappropriation claims brought by substantial 3D printing company
Represented adjustable bed company in breach of contract suit which resulted in a multi-million dollar verdict from a Boston federal jury
Helped autonomous driving company settle various trademark disputes pending before the TTAB and/or before litigation
