On May 18, Day Pitney hosted a one-hour webinar titled, "Am I a Public Utility? A Primer on QFs, EWGs and Market-Based Rate Authority," to discuss the challenges of sorting through the FERC's regulations and practices for Qualifying Facilities (QFs), Exempt Wholesale Generators (EWGs) and Market-Based Rate (MBR) authority. For generators selling their output into the wholesale power markets or to specific users under power purchase agreements, the questions regarding their status as a QF or EWG and whether and when they need MBR authority can be confusing. How they answer those questions will dictate the sorts of regulatory compliance they need to worry about and, when the generator is transferred or retired, the questions can get more complicated. Moreover, failure to answer those questions correctly can result in a call from FERC's Office of Enforcement, and, potentially, some significant financial penalties. Through a series of scenarios, our team of lawyers experienced in these issues will discuss how to make the right decisions and best practices to ensure compliance.
